平成27年改正では、明細書や図面の欠落を補完できるようになります。
例えば、明細書の図面の簡単な説明には図1〜図4と記載されており、図3までしか添付されていないとか、明細書の第14頁が欠落している場合には、特許庁長官から通知され、出願人は補完することができ、補完した日が出願日とみなされます(新38条の4)。
しかし実際には、現在は電子出願であるため、明細書や図面の一部が欠落することはありません。新規定は紙出願を想定した規定です。現在の特許制度では、紙出願で一部が欠落していた場合は、補充すると新規事項の追加となる場合が多く、補充することはできません。
しかし、欠落した頁の内容が偶然にも、出願したクレームの内容と同じであったような場合は、新規事項の追加とはならず、補正が認められます。

The Patent Act amendment in 2015 allows for supplement of lacking parts of the specification or drawing(s).
For example, if a brief description of drawings in the specifications states Figs. 1 to 4, but only Figs. 1 to 3 are attached or, for example, page 14 of the specifications is lacking, the Commissioner of the Patent Office notifies this and orders to supplement it, and the date on which missing drawing(s) or page(s) are supplemented shall be regarded as the application date (Article 38-4 of the new Patent Act).
Actually, however, patent applications are filed electronically at present, so occurrence of missing pages or drawings cannot be presumed. The new provision will cover patent applications filed by paper. Under the present patent system, missing pages or drawings of patent applications filed by paper cannot be supplemented in most cases because of additional new matter.
If, however, supplemented contents are accidentally the same as the already filed documents, such as the scope of claims, the addition of new matter shall not be necessary and such supplement will be acknowledged.
