音の商標についての話題です。特許庁は9月27日にウエブサイトにて
「音楽的要素のみからなる音商標について初の登録を行いました」(https://www.jpo.go.jp/seido/s_shouhyou/otoshouhyou-hatsutouroku.htm)
という発表を行いました。
このニュースを聞いて、「あれ?音が商標って登録されたというニュースは随分前に聞いたじゃない?」と思う人もいるでしょう。私も一瞬はそう思いました。
しかし今回発表されたのは純粋に音からのみなる商標です。歌詞やことばが全く入っていないメロディーだけからなる商標について、初の登録査定が下りました。
特許庁は上記サイト内で「音楽的要素」といっており、「音楽的要素とは、メロディー、ハーモニー、リズム又はテンポ、音色等をいいます」と定義しています。
インテル・コーポレーションのCMで聞くあのメロディだけからなる商標(商願2015-029981号)、
大幸薬品(株)のCMでおなじみのラッパのメロディの商標(商願2015-029809号)
などです。
これまでに登録されたたとえば、久光製薬の音の商標(登録第5804299号)には「ひ・さ・み・つ」という歌詞が入っていたし、伊藤園のおーいお茶(登録第5805757号)はメロディのない言葉の商標です。
ここで改めて気づいたのは、「音の商標」というのはメロディだけからなる商標のみならず、歌詞や話し言葉を含む商標であること、つまり紙に書かれた文字や絵の商標ではないということです。まさに「音」です。「音」は音楽だけではなく、話し言葉でもよいということです。しかも人間がはなすことばだけでなく、動物の声、物の音も含みます。

Today's topic is about “Sound Trademarks." On September 26, the JPO announced the following on its website:

“The JPO has registered sound marks consisting only of musical elements"

You may think, “why is this news being announced now? I've heard that sound marks had been registered before." I had the same thought when I heard this news.
This time, however, the sound marks that have been announced as newly registered trademarks consist only of sounds, with no song lyrics or spoken words. This is the first time that decisions to grant registrations were rendered for such trademarks consisting only of melodies. The JPO uses the phrase “musical elements," which it defines as “melody, harmony, rhythm or tempo, tone, etc."
Both Intel Corporation's sound mark of its often-heard commercial melody (Japanese Trademark Application No. 2015-029981), and Taiko Pharmaceutical's sound mark of its familiar commercial trumpet melody (Japanese Trademark Application No. 2015-029809) were allowed to be registered.
Sound marks that have been registered in the past include Hisamitsu Pharmaceutical's sound mark of the phrase “hi-sa-mi-tsu" (Registration No. 5804299), and Itoen's mark consisting of the spoken word “ooiocha" (Registration No. 5805757).
This made me realize that “sound marks" include not only melodies but also song lyrics or spoken words, excluding trademarks consisting of words or drawings written on paper. This is truly the meaning of a “sound" mark. “Sound" means not only music but also spoken voices including human and animal voices, and the sounds of objects as well.
