「TokkyoWalker」という広報誌が特許庁より発行されています。

特許庁ウエブサイトには、このバナーを「どうぞ御自由に御利用ください。」と書いてあるので、いつも著作権問題でヒヤヒヤしている私も、安心して使えます。

しかしこのロゴを見ると最初は「TokyoWalker」(角川書店)を思い出しますよね。しかしこれは、ロゴにも書いてあるように、「東京ウォーカー責任編集」なのです。
しかも「TAKE FREE」からわかるように、特許庁の無料の広報誌です。無料の広報誌のタイトルは原則として商標ではありません。

念のため「Tokkyo Walker」が商標登録されているかをJ-PlatPatで調べてみました。
すると、驚くことに「TOKKYO WALKER」という商標が2件、ベストライセンス(株)という会社から出されているのです(商願2015-93679号、2016-24991号)。この会社は?と思い、J-PlatPatでこの会社名で検索すると、8,000件以上もの商標がヒットします。ほとんどは出願中です。「STAP細胞はあります」という商標まで出願されています(商願2015-81143号)。

今日は特許庁の広報誌の宣伝をしようと思ったところ、他社の驚くべき商標の発見までがありました。

This logo, however, reminds us of "TokyoWalker" (published by KADOKAWA CORPORATION). As stated under the logo, however, this magazine is "edited by Tokyo Walker".
The phrase "TAKE FREE!" indicates that this is a free JPO magazine. A free magazine title is not a trademark under the Trademark Law in principle.

For reference, I searched if the "Tokkyo Walker" trademark is registered or not at J-PlatPat, and surprisingly found that two applications for "TOKKYO WALKER" were filed for many designated goods including "magazines" by Best License Kabushiki Kaisha (Japanese Trademark Applications 2015-93679, 2016-24991). I searched for this company's trademarks at J-PlatPat, and found among its more than 8,000 trademarks, most of which are pending, and these, a trademark application for "STAP cells are present" was filed by this company (Japanese Trademark Application No. 2015-81143).

Today, I tried to notify JPO's public relations magazine in this blog and eventually found the other company's surprising trademark applications.
