「いきなりステーキ」(第5946491号、(株)ペッパーフードサービス)の特許のつづきです。
客の注文した量のステーキを提供する方法が特許になりました。請求項2〜6には、
カットした肉を焼くための電気やガスで熱した溶岩や炭火を備え、電磁誘導加熱により所定温度まで加熱した鉄皿を備えること、
客のテーブルにはナイフとフォークが備えられていること、温かいステーキソースを入れたポットが備えられていること、
客の人数に応じてテーブルを区切るための可動パーティション(高さ250mm以下)が備えらえていること、

溶岩や炭火、電磁誘導加熱、ナイフ、フォーク、温かいソース、ポット、可動パーティションはすべて既存の技術ですが、これらを組み合わせてオーダーメイドのステーキをつくることに特許性が認められたのでしょう。

これを見て思い出したのが「オートカフェ」の特許です(第2804933号、(株)森商品研究所)。特許請求の範囲は、以下のような短い一文です:
「来店したお客が自動食器貸し機に硬貨を投入し、食器を借り受けその器に飲食物供給装置より飲食物を入れテーブルに運んで飲食するようにした自動飲食店」

これはほとんどカフェの自動販売機といえるものであり、クレーム後半部分は、お客が飲食物をテーブルに運んで飲食するという日常的な行為が述べられています。

ビジネスモデル特許はこのように既存の技術や人間が行う行為を組み合わせて、全体として画期的なシステムが作成されることに特許が付与されるのでしょう。

This is a continuation of the story of the patent for providing a quantity of steak desired by customers at Ikinari Steak (Pepper Food Service Co., Ltd.) (Patent No. 5,946,491).
Claims 2 to 6 of this patent recite that:

Lava or charcoal fire heated by electricity or gas for grilling the cut meat is provided; iron plates heated to the predetermined temperature by electromagnetic induction heating are provided; knives, forks, and pots containing heated steak sauces are provided on customers' tables; and movable partitions for dividing tables in accordance with the number of customers (250 mm high or less) are provided.

Despite combining known technology such as lava, charcoal fire, electromagnetic induction heating, knives, forks, heated sauces, pots, and movable partitions, doing so to prepare order-made steaks was determined as eligible for a patent.

This patent reminds me of the “auto-café" patent (No. 2804933 owned by Mori Shohin Kenkyujo Co., Ltd). The claim of this patent consists of a short sentence:
“An automatic restaurant where customers insert coins into an automatic tableware lending machine, use rental tableware, put food and drink on the tableware, then bring the food and drink to a table and eat it there".
The Ikinari Steak model is very similar to automatic café vending machines, and the latter part of the claim states customers' routine acts of bringing food and drink to their table and eating it there.

Business model patents which consist of existing technology and acts performed by humans but produce epoch-making systems as a whole may be patented.
