「きのこの山」((株)明治)の形状が立体商標として登録されたことがニュースになっています。
J-PlatPat(特許庁、INPIT)で早速調べたところ、確かに3月30日付けて商標登録されていました(第6031305号)。

ところで立体商標とは何でしょうか?通常、商標はDELL、NEC、日立のマークなど文字や図形で表します(平面商標)。しかし商品や包装の独特の形状も他社の製品と区別できるため、このような立体的形状の商標として構成するのが立体商標です。
商品の看板や広告も立体商標となります。たとえばケンタッキーフライドチキンのカーネルサンダースの人形は商標登録されています。

ところで「きのこの山」といえば「たけのこの山」が思い浮かぶでしょう。これについてはJ-PlatPatで(株)明治の名称で商標出願を検索したところ、今日現在のデータでは出願されてないようです。
「きのこの山」派と「たけのこの里」派、どちらですか?という議論を聞いたことがありますが、立体商標が登録された「きのこの山」に軍配があがってしまうのでしょうか。

According to a new report, the shape of “Kinoko-no-Yama" (a.k.a. “Chocorooms" produced by Meiji Co., Ltd.) was registered as a three-dimensional trademark.

As soon as I heard this news, I searched for the trademark on J-PlatPat (JPO, INPIT) to confirm that it was indeed registered on March 30 (No. 6031305).

What are three-dimensional trademarks?
Ordinarily, trademarks consist of letters or drawings, such as DELL, NEC, or the Hitachi logomark (planar trademarks). On the other hand, unique shapes of products or packaging can be distinguished from other products by registering three-dimensional trademarks.
Signboards or advertisements of products can be three-dimensional trademarks. For example, this doll of Colonel Sanders has been registered as a three-dimensional trademark (No. 4153602) and is owned by Kentucky Fried Chicken.

In Japan, there is another chocolate-covered snack similar to Kinoko-no-Yama (Chocorooms) known as “Takenoko-no-Sato" (“Village of Bamboo Shoots"). I searched on J-PlatPat to see if the Takenoko-no-Sato shape had been registered as a three-dimensional trademark or not, but according to today's accumulated data it appears to have not yet been filed.
I have heard the question, “which do you prefer, Kinoko-no-Yama or Takenoko-no-Sato?" I wonder if Kinoko-no-Yama's three-dimensional trademark registration means that it finally became the more popular choice?
