意匠法改正法の施行日は来年4月1日であることが閣議決定されました。
意匠法改正のポイントは、

• 画像の保護対象が広がること
• 建築物、内装が意匠の保護対象に加えられること
• 関連意匠制度の改正

です。まず画像の意匠保護について話します。

これまでも、操作画像(例、スマホや計算機の操作画面)、表示画像(例、ヘルスメータの画面に表示される画像)

は意匠登録の対象となっていましたが、改正法では物品と結びつかない画像

• 壁や道路に投影される画像
• PCのメモリ上にないが、サーバ上に存在する画像(例、乗換案内の表示画面の画像)
• (操作ボタンを兼ねた)アイコン画像
• ウエブサイト上の画面(例、ショッピングモールサイトの購入画面)

などが意匠の対象に入ります。
ただし、注意すべき点はコンテンツ画像は意匠の対象に入らないということです。たとえばゲームソフトで登場する漫画の画像、無料素材ソフトの風景画像などは意匠の対象ではありません。
今後とも意匠法改正について伝えていきます。

The Cabinet decided that the new Design Law will take effect as of April 1, 2020.
Key points of the amended Design Law are:

• Expansion of objects to be protected to include images;
• Buildings and interiors will be added to objects to be protected; and
• Amendment of the related design system.

Firstly, I will explain protection of images.
Operation images (e.g., operation screens of computers and smartphones) and displayed images (e.g. images displayed on health meters) up until now have been targets of design registrations. The amended Law extends targets to include images that are not combined with articles, such as:

• Images projected on walls or roads
• Images that are not stored on PC memories but are stored on servers (e.g. a guidance image for changing trains)
• Icon images (which also function as operation buttons)Screens for websites (e.g. a purchase screen on a shopping mall site).

Please, however, bear in mind that images used as contents are excluded as targets of designs, for example, images of characters which appear in game software, background images in free software, and so forth.
I will subsequently inform you of the amended Design Law.
