進歩性の判断の際に、引用発明に本発明を想到する「示唆」が存在するか否かを判断する、という基準があります。
示唆とは具体的にどのような意味でしょうか。
引用発明の文献中に、本発明の特徴点を思いつくヒントがある、という意味ですが、その「示唆」について判決が出されています。
「当該発明が容易想到であると判断するためには,先行技術の内容の検討に当たっても,当該発明の特徴点に到達できる試みをしたであろうという推測が成り立つのみでは十分ではなく,当該発明の特徴点に到達するためにしたはずであるという示唆等が存在することが必要である」(平成20年(行ケ)10096号、知財高裁)

「本発明の特徴点に到達するための試みをしたであろう」では不十分であり、
「本発明の特徴点に到達するための試みをしたはずである」までが必要である。

引用文献に示唆があれば、本発明をすることは容易
引用文献に示唆もないのに本発明をしたことは容易でないから、進歩性あり
という判断の流れになり、この事件では示唆がないから進歩性ありと判断されています。

本発明にはビスフェノールF型フェノキシ樹脂が必須の成分として含まれています。これを含めることは、引用文献(特開平6-256746号)には示唆はないと判断されました。引用文献には、フェノキシ樹脂は、相溶性がよく、また接着性も良好であることが記載されているが、回路用接続部材用の樹脂組成物を調製するには、耐熱性、絶縁性、剛性、粘度等他の要素も必要になるからです。

It shall be determined as per the standards whether “suggestion” for conceiving the present invention is present in cited inventions when determining an inventive step.
What does “suggestion” exactly mean?
It means that there is a hint for conceiving features of the present invention in documents of the cited invention. A court decision showing a degree of “suggestion” has been rendered.
“In order to determine that the present invention could be easily conceived, even in examining prior art, it is not enough to establish an assumption that an attempt was likely made to arrive at the features of the present invention; the presence of suggestion, etc. that an attempt was certainly made to arrive at the features of the present invention is required” (Heisei 20(gyo-ke) No. 10096, Intellectual Property High Court).

The flow of determination is:
it is easy to make this invention if there is suggestion in cited documents, while
it is not easy to make this invention if there is no suggestion in cited documents.
According to this flow, an inventive step was affirmed because there is no suggestion in this case.

The present invention contains a bisphenol F-type phenoxy resin as an essential component. It was judged that containment of this substance is not suggested in the cited document (Japanese Publication No. 6-256746). This is because while the cited document describes that a phenoxy resin is excellent in compatibility and in adhesive property, other elements such as heat resistance, insulation, rigidity, and viscosity are necessary for preparing resin compositions for circuit connection members.
