新しい意匠制度の下での登録例を紹介してきましたが、今回は、道路に投影された画像の意匠登録第1号を紹介します。

これは、車両から路面に投射される画像であり、走行時または停車時は車両の周辺に照射されます。運転手にとっては、車両周辺の状況を確認しやすくなり、外部からは車両の存在を認識しやすく効果があります。
車両が方向を変更するときは、向きに応じて照射が変化します。

この道路に投影される画像は、車内外の双方から車両を認識しやすくするという技術的効果を有しています。これはデザインより技術的効果に力点が置かれていると考えます。車両の周囲を照らす装置という特許の1つの図面のようです。
新しい意匠制度の下、技術的効果の保護を求める意匠登録が数多くなされると予想します。米国では意匠は意匠特許ともいわれています。日本でも意匠と特許が全く別の対象を保護するのは無理があったのかもしれません。

This is an image that is projected from a vehicle onto a road surface, and it illuminates around the vehicle when the vehicle is moving or stopped. It makes it easier for a driver to check the conditions around the vehicle, and for persons outside the vehicle to recognize its presence.
When the vehicle changes direction, the illumination will also change according to this direction.

The image projected onto the road has the technical effect of making it easier to identify the vehicle from both inside and outside the vehicle. I think that the emphasis is on this technical effect, rather than the design. The above figure looks like a drawing from a patent for a device for illuminating a vehicle's surroundings.

Under the new design system, I expect the number of design registrations seeking protection for a design’s technical effects will be high. In the U.S., designs are also referred to as ‘design patents.’ It may have been impossible in Japan for a design and a patent to protect a completely different subject.
